Welcome to Publicly Private LLC. These Terms and Conditions (“Terms”) govern your use of our website and the purchase of our products. By accessing the Site, you agree to be bound by these Terms.
ONLINE STORE TERMS
By using this Site, you represent that you are at least the age of majority in your state of residence. You agree not to use our products for any illegal or unauthorized purpose, and you shall not violate any laws in your jurisdiction (including but not limited to copyright laws).
INTELLECTUAL PROPERTY & DESIGN RIGHTS
The Site and its original content, features, and functionality including the Publicly Private name, logos, technical garment sketches, specific design elements (such as the centered red triangle logo), and silhouettes are the exclusive property of Publicly Private LLC.
Strict Prohibition: Any unauthorized reproduction, "sampling," or distribution of our proprietary designs or trademarked assets is strictly prohibited. We reserve the right to take legal action to protect our brand's visual identity.
PRODUCT ACCURACY & AVAILABILITY
Visual Precision: We strive to display the colors and textures of our heavyweight cottons and silhouettes as accurately as possible. However, we cannot guarantee that your device’s display will perfectly reflect the actual garment.
Limited Quantities: Due to the exclusive nature of our collections, we reserve the right to limit the quantity of products per person, household, or order.
THE "DROP" CLAUSE (LIMITED RELEASES)
During high-traffic limited releases ("drops"), technical errors or inventory lags may occur.
Order Refusal: We reserve the right to refuse or cancel any order if a product was inadvertently listed as "In Stock" when sold out.
Correction: If your payment was already processed for a cancelled order, a full refund will be issued immediately to your original payment method.
THIRD-PARTY TOOLS & SERVICES
We may provide you with access to third-party tools (such as shipping trackers or payment processors). You acknowledge that we provide access to such tools ”as is” without any warranties or conditions of any kind.
LIMITATION OF LIABILITY
Publicly Private LLC shall not be liable for any direct, indirect, or consequential damages resulting from your use of the site or garments. Our liability is limited to the maximum extent permitted by New York State law.
GOVERNING LAW
These Terms and any disputes arising from them shall be governed by and construed in accordance with the laws of the State of New York. Any legal proceedings shall take place exclusively in the state or federal courts located in New York, NY.
